Note:

A contract must be signed by the recruiting company or an advertising agency representing the recruiting company. The party that signs this is responsible for any short rate no matter where the individual insertion orders come from.

Example 1: A recruiting company signs a frequency contract and then places ads through an advertising agency. At the end of the contract period, fewer ads than were agreed to have been placed. The recruiting company would then be responsible for the difference between what was charged under the frequency contract and what should have been actually charged. Under this scenario the agency would not be responsible for any short rate.

Example 2: An advertising agency signs a frequency contract for a specific client. Subsequently the recruiting company does not allow the advertising agency to run at the frequency required to qualify for the discounted rate. Under this scenario the advertising agency would be responsible for the difference in what should have been charged.
